Terms and Conditions

All work is performed on an understanding that the client agrees to Fixtatik's terms.

1.0 General Conditions

1.1 Prices quoted by Fixtatik include all state and federal taxes.
1.2 Agreeing to a quote and given permission to being work on a project provides general acceptance that the client agrees to Fixtatik's Terms and Conditions.
1.3 Fixtatik makes every effort to assure that design will work in all current versions of the most popular browsers. We can not be held responsible for how pages are displayed on versions that are released after the project is completed.
1.4 If a choice of designs is offered to the client, only one will be released. All other versions of a design will remain the property of Fixtatik.
1.5 Time frames to complete a project given by Fixtatik are an estimate. We can not accept responsibility for project over-runs.
1.6 If you are an individual, band, or company that has had a design done through ONLY1NE Visual Communications, we do not accept design requests through Fixtatik, unless an agreement has been made with ONLY1NE. Please continue your design work with them.

2.0 Pricing

2.1 If the total payment is to be less than $50, full payment must be sent and received before design work begins.
2.2 If payment is to be $50 or more, 50% of the final invoice is to be paid upon agreement of Fixtatik's Terms and Conditions, unless otherwise agreed.
2.3 Payments may be made by PayPal.
2.4 All clients are protected under a satisfaction guaranteed policy. If you are displeased with a design, the full amount that was paid will be refunded, unless a design has already been released.

3.0 Copyrights and Trademarks

3.1 By supplying text, images, or any other data to Fixtatik, the client grants Fixtatik permission to use this material freely for the customer's design.
3.2 If any data is supplied by either Fixtatik or the customer, this data must be copyright and royalty free.
3.3 All material provided by the client will remain the client's property.
3.4 All material provided by Fixtatik will remain Fixtatik's property.

4.0 Design Credits

4.1 The customer agrees that a small credit will be placed on the design. For websites, a textual link and for graphic media, a small copyright.
4.2 The client agrees to allow Fixtatik to display completed designs and a link to the customer's site on Fixtatik's own website for demonstrative purposes.
